Please read these Terms and Conditions ("Terms") carefully before using the floscale.ai website and FloScale platform (the "Service") operated by FloScale ("us", "we", or "our").

Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

Description of Service

FloScale provides a B2B multichannel outreach automation platform that includes LinkedIn automation, email outreach, SMS messaging, AI voice calling, intelligent prospect qualification, and AI content generation. The Service is available as a self-serve platform (DIY) and as a managed service (Done For You).

Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

Subscriptions and Payment

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring monthly basis. Subscription fees are non-refundable except as outlined in our Refund Policy.

FloScale reserves the right to modify subscription fees at any time. Any fee changes will be communicated with at least 30 days notice before taking effect.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable national, state, or international law or regulation
  • Send unsolicited commercial communications (spam) through the Service
  • Violate the terms of service of any third-party platform integrated with the Service, including LinkedIn, email providers, and telecommunications networks
  • Impersonate or attempt to impersonate FloScale, a FloScale employee, another user, or any other person or entity
  • Use the Service to harvest, collect, or gather user data without consent
  • Use the Service in any manner that could disable, overburden, damage, or impair the Service
  • Use any automated means (robots, scrapers, etc.) to access the Service for any purpose without our express written permission, except through the automation features we provide

LinkedIn and Third-Party Platform Compliance

You acknowledge that use of the Service in connection with LinkedIn and other third-party platforms is subject to those platforms' terms of service. FloScale provides automation tools, but you are solely responsible for ensuring your use of these tools complies with all applicable platform policies. FloScale is not liable for any consequences arising from your use of the Service in violation of third-party platform terms.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of FloScale. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FloScale.

Content You Provide

You retain all rights to content you submit, post, or display through the Service, including outreach messages, blog posts, and other materials. By providing content to the Service, you grant FloScale a licence to use, store, and process that content solely for the purpose of providing the Service to you.

AI-Generated Content

The Service includes AI-powered content generation features. While we strive for high quality output, AI-generated content may contain errors, inaccuracies, or inappropriate material. You are responsible for reviewing and approving all AI-generated content before it is sent or published. FloScale is not liable for any consequences arising from the use of AI-generated content.

Data Processing

In providing the Service, FloScale processes data on your behalf, including contact information of your prospects and leads. You represent and warrant that you have the right to process this data and that your use of the Service complies with all applicable data protection laws including the Australian Privacy Act 1988 and, where applicable, the EU General Data Protection Regulation (GDPR).

Limitation of Liability

In no event shall FloScale, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Service.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
